GLOBAL DISPUTE RESOLUTION AND GLOBAL BUSINESS LAW
Our legal practice focuses on International Dispute Resolution before domestic courts, arbitral tribunals, international tribunals, and mediators, with a singular emphasis on International Commercial Arbitration and Investment-Treaty Arbitration. We represent private corporations, States, and State-owned enterprises on the full spectrum of the dispute resolution process in matters arising in a wide range of industry sectors anywhere in the world. We draw on our legal expertise and industry knowledge as we leverage our multicultural and multilingual capabilities to tailor strategies that nimbly navigate the legal, technical, and geopolitical complexities inherent to global disputes.
We also counsel businesses on legal issues that arise in connection with cross-border business transactions, including international sale of goods and services, agency, distributorship, technology transfer, contract manufacturing, franchising, and foreign direct investment, across a variety of industry sectors. We advise clients on applicable US, foreign, and international laws, and assist them in contract drafting and negotiations, optimized transaction structuring, and intellectual property protection.
LEGAL EXPERTISE AND INDUSTRY KNOWLEDGE
We were members of high-profile international dispute resolution practice groups. We have successfully represented Fortune 500 companies, sovereign States, and State-owned entities in cross-border litigation and arbitration proceedings involving complex matters with amounts in dispute exceeding 500 million US dollars. These matters concerned cross-border transactions and large-scale infrastructure projects in diverse industry sectors including construction, mining, oil and gas, electricity, defense, information technology, telecommunications, finance, pharmaceuticals, and cosmetics.
We advise clients on each stage of the dispute resolution process, from the negotiation of arbitration clauses in non-contentious settings, to mediation, and the conduct of arbitral proceedings, including advocacy at trial, through to the enforcement and setting aside of arbitral awards. We have represented clients in matters arbitrated under the rules or auspices of major institutions including:
- International Chamber of Commerce (ICC);
- International Centre for Settlement of Investment Disputes (ICSID);
- Permanent Court of Arbitration (PCA); and
- United Nations Commission on International Trade Law (UNCITRAL).
One of our team members worked at the Secretariat of the International Court of Arbitration of the ICC managing over a hundred arbitral proceedings. This included handling the procedure until the constitution of the Arbitral Tribunal, providing assistance to parties and arbitrators at every stage of the proceedings, and the presentation of matters to be decided by the Court, including the scrutiny of draft awards.
